INTRODUCTION

Purpose. The purpose of this Privacy Policy is to describe how Bakerly LLC (d/b/a bakerly - collectively referred to herein as the “Company”), collects, uses and shares information about you through our online interfaces (e.g., websites and mobile applications) owned and controlled by us, including www.bakerly.com (collectively referred to herein as the “Site”). Scope; Third Party Sites. This Privacy Policy applies only to information we collect at and through the Site. Our Site also contains links to third party sites that are not owned or controlled by Company. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our Site and to read the privacy statements of each and every website that collects personal information.

Applicable Terms and Conditions. Please note that your use of our Site is also subject to our Terms of Use, and your purchase of products from our Site is subject to our Terms of Sale.

 

THE INFORMATION WE COLLECT

Information You Provide to Us

There are three ways that bakerly obtains information from you through the Site: (1) via registration on the bakerly website; and (2) from an online purchase.

How We Use The Information

We collect information you provide to us, for example when you create or modify your account, register to use our Site, purchase products from us, request information from us, contact customer support, or otherwise communicate with us. This information may include:

- Name

- Home address

- Company address

- Billing address

- Shipping address

- Email address

- Telephone number

- Credit / debit card number (solely for payment purposes)

- User generated content (product feedback and comments)

Information We Collect Through Your Use of our Site

Google Analytics

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect certain information relating to your use of the Site. Google Analytics uses “cookies”, which are text files placed on your computer, to help the Site analyze how users use the Site. Google Analytics Remarketing

We may also use Google Analytics Advertising Features or other advertising networks to provide you with interest-based advertising based on your online activity as further detailed under the Interest-Based Advertising heading below. You have the option to permanently object to Google remarketing / targeting across all devices by deactivating personalized advertising in your Google account. Other Website Analytics

In addition to Google Analytics, we also use the following web analytics services to collect certain information relating to your use of the Site in order to help the Site analyze how users use the Site:

  • Facebook Pixels provided by Facebook, Inc. This tool allows the tracking of page visitors after they have been linked to the Site after clicking on a Facebook ad. This makes it possible to analyze the effectiveness of Facebook ads for statistical and market research purposes and to optimize future advertising campaigns. For us as the operators of this Site, the collected data is anonymous. We are not in a position to arrive at any conclusions as to the identity of users. However, Facebook archives the information and processes it, so that it is possible to make a connection to the respective user profile and Facebook is in a position to use the data for its own promotional purposes in compliance with the Facebook Data Usage Policy. This enables Facebook to display ads on Facebook pages as well as in locations outside of Facebook. We have no control over the use of such data. SMS Service policy

We value your privacy and the information you consent to share in relation to our SMS marketing service. We use this information to send you text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us.Opt-in data and consent for text messaging will not be shared with any third parties except for messaging partners,for the purpose of enabling and operating our text messaging program.

Our website uses cookies to keep track of items you put into your shopping cart, including when you have abandoned your checkout. This information is used to determine when to send cart reminder messages via SMS.

Information Collected Through Cookies and Similar Technologies

We and our service providers use cookies (persistent and session), web beacons, and other technologies to receive and store certain types of information whenever you interact with our Site through your computer or mobile device. A cookie is a small file containing a string of characters that is sent to your computer when you visit a website. When you visit the Site again, the cookie allows the Site to recognize your browser. Cookies may store unique identifiers, user preferences and other information. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Site features or services may not function properly without cookies. We use cookies to improve the quality of our service, including for storing user preferences, tracking user trends and providing relevant advertising to you. (See, “Advertising” below.)

No Information from Children Under Age 13

We do not knowingly contact or collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us so we can promptly obtain parental consent or remove the information. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us using the contact information first written above. We will delete such information from our files within a reasonable time.

 

HOW WE USE AND SHARE YOUR INFORMATION

To Provide Products and Information. We collect information from you in order to provide products that you purchase using the Site; register and service your online account; provide information that you request from us; contact you about your orders, including contacting you by phone or via text message; process credit card and debit card transactions; ship products to you; send you promotional materials or advertisements about our products, as well as new features and offerings; administer surveys, sweepstakes, promotions and contests; provide interest-based targeted advertising to you.

Sharing with Third Parties. We may provide information to third party service providers that help us operate and manage our Site, advertise, market or promote our products, process orders, and fulfill and deliver products that you purchase from us. These service providers will have access to your personal information in order to provide these services, but when this occurs, we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the service.

Payment Processing.  We process payment information through a third-party service provider called a secure payment processor.  Anytime you are asked to provide payment card information for payment to bakerly through the Site, you are actually entering your payment card information directly to our payment processor’s systems.  We enter into contracts with our payment processors pursuant to which they are obligated to process your payment card information securely in accordance with the Payment Card Industry Data Security Standard (“PCI-DSS”), an information security standard for organizations that handle branded credit cards from major credit card brands.    We do not collect, store or otherwise process your payment card information on our systems except for limited, redacted information, not including any payment card account numbers.  As of the Effective Date first noted above, our secure payment processor is Stripe.  You should review information about Stripe’s data handling policies and terms of service, available from their website (https://stripe.com/us/privacy).

Sweepstakes, Promotions, and Surveys.  From time to time, we may invite you to complete a survey, and/or offer you the opportunity to participate in sweepstakes or other promotion through our Site, or through a third party platform. If you choose to participate in a such a promotion or survey, we will collect, store, use, and disclose the information you provide in accordance with this Privacy Policy unless stated otherwise, such as in the official rules (or other guidelines) of the promotion or as stated in another privacy policy that may govern that promotion. Your information may be used to contact you for winner notification, prize delivery confirmation or other related purposes and/or in accordance with this Privacy Policy. Your entry in the promotion may also result in your being added to our mailing lists as well as those of our promotional partners associated with the contest or sweepstakes. Acceptance of a prize may require you (unless prohibited by law) to allow us to post publicly some of your information on any of our Sites, such as on a winner's page, in the event you win a contest or sweepstakes. In some instances, a third-party advertiser or sponsor may operate or host a promotion on or through our Sites, and collect your information. In those cases, where we are not the sponsor or operator of the promotion, we have no control over the information collected and you should review the official rules as well as the advertiser's or sponsor's privacy policy applicable to the promotion before participating.

Advertising. We may use how you browse and shop in order to show you ads for Company or our advertising partners that are more relevant to your interests. Through services such as Google Analytics and Facebook Pixel referenced above, cookies and other information will be used to provide relevant interest-based advertising to you. Interest-based ads are ads presented to you based on your browsing behavior in order to provide you with ads more tailored to your interests. These interest-based ads may be presented to you while you are browsing our site or third-party sites not owned by Company.

We belong to ad networks that may use your browsing history across participating websites to show you interest-based advertisements on those websites. You can opt-out of receiving interest-based ads from us by deleting all cookies in your browser, resetting your browser to refuse all cookies, and by taking advantage of the service specific opt-out procedures detailed above. Please note though that some Site features or services may not function properly without cookies. Social Media Widgets. Our Site may include social media features, such as the Facebook Like button, Instagram, Pinterest, Twitter, and/or similar widgets. These features may collect information about your IP address and which page you're visiting on our Site, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with those features are governed by the privacy policies of the companies that provide them.

DNT / Do Not Track.  Do Not Track (DNT) is a privacy preference that you can set in certain web browsers. When you turn on DNT, the browser may send a signal or other message to web services requesting that they not track you. At this time, our information collection practices will continue to apply as described in this Transparency Statement, regardless of any DNT signals that are sent by certain browsers or selected by you. Your Consent. In addition to the sharing described elsewhere in this Policy, we will share personal information with companies, organizations or individuals outside of Company when we have your consent to do so.

Legal Proceedings. We will share personal information with third party companies, organizations or individuals outside of Company if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

- Meet any applicable law, regulation, subpoena, legal process or enforceable governmental request.

- Enforce applicable Terms of Use, including investigation of potential violations.

- Detect, prevent, or otherwise address fraud, security or technical issues.

- Protect against harm to the rights, property or safety of Company, our users, customers or the public as required or permitted by law, including without limitation establishing or protecting legal claims and defenses.

Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.

 

ACCESS TO YOUR INFORMATION AND CHOICES

You can access and update certain information we have relating to your online account by signing into your account and going to the “My Account” section of our Site. If you are signed up for mobile text messaging communications from the Company but later decide you no longer wish to receive them, you may opt-out of receiving text messages from us by emailing us at mooo@bakerly.com or by mailing us a written request to 2600 Douglas Rd, Suite 410, Coral Gables, FL 33134. Before changing your mobile phone number, you agree that you will opt-out of ALL text messages from Company.

You can close your online account by calling us at 786-539-5888, emailing us at mooo@bakerly.com, writing to us at 2600 Douglas Rd, Suite 410, Coral Gables, FL 33134, or you can contact us. If you close your account, we will no longer use your online account information or share it with third parties. We may, however, retain a copy of the information for archival purposes, and to avoid identity theft or fraud.

 

SECURITY OF YOUR INFORMATION

We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your personal information. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that e-mails and other communications you send to us through our Site are not encrypted, and we strongly advise you not to communicate any confidential information through these means.

 

CHANGES TO OUR PRIVACY POLICY

Our Privacy Policy may change from time to time. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of privacy policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review.  Use of the Site following a posted change to the Privacy Policy indicates you agreement to such changes.

Jurisdiction.  We process your data as described in this Privacy Policy in the United States of America.  The Site is not targeted towards, nor is the Site intended for use by users outside of the lower 48 contiguous United States of America and the District of Columbia.  We do not represent or warrant that this Site is suitable for access or use outside of our territory and visitors accessing this Site from outside of our territory do so at their own risk.
