1. Introduction

This Privacy Policy describes how Bakerly LLC (doing business as β€œbakerly”) (β€œCompany,” β€œwe,” β€œus,” or β€œour”) collects, uses, and shares information about you when you visit or make a purchase from www.bakerly.com and any other websites, mobile applications, or digital services we own or operate (collectively, the β€œSite”).

Our principal place of business is 4300 East Braden Blvd., Easton, PA 18040.

If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

2. Information We Collect

2.1 Information You Provide

We collect information you provide directly to us, including when you:

  • Create or sign in to an account
  • Place an order or purchase a subscription
  • Sign up for email or SMS marketing
  • Participate in a promotion, sweepstakes, or survey
  • Contact our customer support team via chat, email, or phone
  • Submit a product review or other user-generated content

This information may include: your name, email address, phone number, billing and shipping address, payment card information (processed directly by our payment processors β€” we do not store full card numbers), order history, loyalty program activity, subscription preferences, and any communications you send to us.

We do not collect health, biometric, or precise geolocation data. Financial data (payment card numbers and bank account information) is processed exclusively by our PCI-DSS certified payment processors and is not stored on our systems. We do not collect sensitive personal information beyond what is strictly necessary to process your transactions and provide our services.

2.2 Information Collected Automatically

When you visit or interact with the Site, we and our service providers automatically collect certain technical and behavioral information, including:

  • IP address and approximate geographic location
  • Browser type, operating system, and device identifiers
  • Pages viewed, links clicked, and time spent on pages
  • Referring URLs and exit pages
  • Shopping cart and checkout behavior, including abandoned carts
  • Interactions with our chat widget, emails, and SMS messages

This information is collected using cookies, pixel tags, web beacons, and similar technologies as described in Section 4.

2.3 Information from Third Parties

We may receive information about you from third-party sources, including our advertising partners (such as Meta and Google), our loyalty and reviews platform (Yotpo), and our email and SMS platform (Klaviyo), to help us understand how you interact with our advertising and communications.

3. How We Use Your Information

We use the information we collect to:

  • Process and fulfill your orders, including shipping, returns, and subscription management
  • Manage your account and loyalty program membership
  • Send transactional communications (order confirmations, shipping updates, subscription reminders)
  • Send marketing and promotional communications, including email and SMS, where you have opted in

  • Display interest-based advertising on our Site and on third-party platforms
  • Conduct website optimization and A/B testing
  • Operate promotions, sweepstakes, and surveys

  • Respond to customer support inquiries
  • Make automated product recommendations and detect potentially fraudulent orders using automated tools (including Rebuy for recommendations and Shopify’s fraud analysis for orders). 4. Cookies and Tracking Technologies

We use cookies (persistent and session), pixel tags, and similar technologies to operate and improve the Site. You can control cookies through your browser settings and our cookie consent banner. Disabling certain cookies may affect Site functionality.

We use the following categories of cookies:

  • Strictly necessary: Required for the Site to function (shopping cart, checkout, account login). These cannot be disabled.
  • Functional: Remember your preferences and personalize your experience.
  • Analytics: Help us understand how visitors use the Site.
  • Marketing / advertising: Used to serve relevant ads and measure ad performance. Subject to your consent where required by law.

For California, Virginia, Colorado, Connecticut, Texas, Oregon, Montana, and other applicable state residents, we display a cookie consent banner before activating non-essential tracking technologies. You may withdraw consent at any time through the cookie preference link in our Site footer.

You may also opt out of interest-based advertising from participating companies through the Digital Advertising Alliance (aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org). Note that opting out through these services does not prevent you from seeing ads β€” it means those ads will not be tailored to your interests.

5. Third-Party Vendors and Service Providers

We share information with the vendors and categories of providers below. Vendors or categories marked β€œSale / Sharing” involve data sharing that may constitute a β€œsale” or β€œsharing” of personal information under California law. Our Site is hosted on Shopify. Shopify independently collects and processes certain information about your access to and use of the Services. The following vendors receive data that may constitute a β€œsale” or β€œsharing” under California law. We name each vendor so you can independently review their privacy policies and exercise platform-level opt-outs.

6. How We Share Your Information

In addition to the vendor sharing in Section 5, we may share your personal information in these circumstances:

6.1 Service Providers

Service providers are contractually required to use your information only to provide services to us and in accordance with this Privacy Policy.

6.2 Business Transfers

If Bakerly LLC is involved in a merger, acquisition, asset sale, or bankruptcy, your personal information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

6.3 Legal Requirements

We may disclose your information where necessary to: (a) comply with applicable law or legal process; (b) enforce our Terms of Service; (c) detect, prevent, or address fraud or security issues; or (d) protect the rights, property, or safety of Bakerly LLC, our customers, or the public.

6.4 Promotions and Sweepstakes

If you participate in a sweepstakes, contest, or promotion through our Site or through a third-party platform (such as ViralSweep), we will collect and use your information in accordance with this Privacy Policy and any official rules applicable to that promotion. By entering, you may be added to our marketing mailing list. You may opt out at any time using the unsubscribe link in any marketing email. Where a third-party advertiser or sponsor operates or co-hosts a promotion, that party may independently collect your information, and you should review their privacy policy before participating.

7. SMS / Text Message Marketing

If you opt in to receive SMS marketing messages:

  • Opt-in data and consent will not be shared with any third party for their own marketing purposes.
  • We use Klaviyo as our SMS platform. Klaviyo accesses message data solely as a service provider to enable our program.
  • Message frequency varies. Message and data rates may apply.
  • Cart abandonment cookies may be used to trigger cart reminder SMS where you have opted in.
  • To opt out at any time, reply STOP to any message, email happysupport@bakerly.com, or write to us at Bakerly LLC, Attn: SMS Opt-Out, 4300 East Braden Blvd., Easton, PA 18040. For help, reply HELP.
  • Opting out of SMS marketing does not affect transactional messages related to your orders.

8. Subscription Services

If you purchase a subscription through our Site, the following additional terms apply to the collection and use of your information:

  • We collect and store your subscription preferences, billing frequency, selected products, and subscription status to manage your recurring orders.
  • Recurring billing authorization is stored and processed by our payment processors (Shopify Payments and Stripe) and our subscription management platform (ReCharge). We do not store full payment card numbers on our systems.
  • We use your subscription data to send you order confirmation, renewal reminders, shipping notifications, and subscription management communications. These are transactional messages and are not affected by marketing opt-out preferences.
  • You may pause, modify, or cancel your subscription at any time by logging in to your account at bakerly.com, contacting us at happysupport@bakerly.com, or calling 786-539-5888. Cancellation will take effect before your next scheduled renewal. We will not charge you for any renewal period after a valid cancellation is processed.
  • Subscription data is retained for the duration of your subscription plus seven (7) years for financial and legal compliance, consistent with our data retention policy in Section 9.

9. Data Retention

We retain personal information as long as necessary to fulfill the purposes in this Privacy Policy or as required by law:

  • Account and order data: Active account duration plus seven (7) years for tax and legal compliance.
  • Email and SMS marketing lists: Until you unsubscribe or request deletion, after which we suppress your contact to prevent future sends.
  • Customer support records: Three (3) years from your last interaction.
  • Cookie and analytics data: Per each provider’s retention policies. Google Analytics data is retained up to 14 months by default.
  • Payment data: We do not store full card numbers. Transaction records retained for seven (7) years for financial compliance.

You may request deletion as described in Section 11. We may retain certain data where required by law or for fraud prevention.

10. Do Not Sell or Share My Personal Information

California residents have the right to opt out of the β€œsale” or β€œsharing” of their personal information for cross-context behavioral advertising under the CCPA/CPRA. We engage in such sharing as described in Section 5.

You may also decline advertising cookies via our cookie consent banner, or email happysupport@bakerly.com with the subject line β€œDo Not Sell or Share My Information.” We will process requests within 15 business days.

If your browser has Global Privacy Control (GPC) enabled, we treat your visit as an opt-out request automatically. We do not sell or share personal information of consumers we know are under 16 years of age.

11. California β€œShine the Light” Disclosure

California Civil Code Section 1798.83 (the β€œShine the Light” law) permits California residents to request, once per year and free of charge, information about the categories of personal information (if any) we disclosed to third parties for their own direct marketing purposes in the preceding calendar year. If you are a California resident and wish to make such a request, please contact us at happysupport@bakerly.com with the subject line β€œShine the Light Request.” We will respond within 30 days.

12. Your Privacy Rights

12.1 California Residents (CCPA / CPRA)

We will respond to verifiable consumer requests within 45 days, extendable by an additional 45 days with notice. We may deny requests where an exception applies and will explain the reason in writing.

12.2 Virginia, Colorado, Connecticut, and Other State Residents

Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and other states with applicable privacy laws have similar rights to access, correct, delete, and opt out of certain uses of their personal information. Submit requests as described in Section 11.3. We will respond within the timeframes required by applicable law.

12.3 How to Submit a Request

To close your account entirely, contact us using any of the methods above. Upon account closure, we will cease using your information for marketing purposes and will process any deletion request subject to our retention obligations described in Section 9.

12.4 Complaints and Appeals

If you have a complaint about how we handle your personal information, or if you would like to appeal a decision we made in response to a privacy rights request, please contact us at happysupport@bakerly.com with the subject line β€œPrivacy Complaint” or β€œPrivacy Appeal.” We will respond within the timeframe required by applicable law. Depending on where you live, you may also have the right to lodge a complaint with your local data protection authority.

13. Children’s Privacy

Our Site is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe your child has provided us personal information, contact us at happysupport@bakerly.com and we will delete it promptly. We do not sell or share personal information of consumers we have actual knowledge are under 16 years of age.

14. Security

We use industry-standard physical, technical, and administrative safeguards to protect your personal information. Our payment processors (Shopify Payments and Stripe) are PCI-DSS certified. We do not store full payment card numbers.

No internet transmission or electronic storage is completely secure. If you believe your account has been compromised, contact us immediately at happysupport@bakerly.com or 786-539-5888.

15. Third-Party Websites and Social Media

Our Site contains links to third-party websites and may include social media features and widgets such as Facebook Like buttons, Instagram feeds, TikTok embeds, and LinkedIn share buttons. These features may collect your IP address, record which pages you visit, and set cookies to function properly. Social media features may be hosted directly on our Site or by the third-party platform. Your interactions with those features are governed by the privacy policies of the companies that provide them. We are not responsible for the data practices of any third-party website or social media platform.

16. Jurisdiction

Bakerly LLC is based in the United States and processes personal data in the United States. This Privacy Policy is governed by the laws of the State of Florida and applicable United States federal law, including the CCPA and CPRA with respect to California residents.

17. Changes to This Privacy Policy

We will post any changes to this page and revise the β€œLast revised” date. For material changes, we will notify you by email or prominent Site notice before the changes take effect.
